Brawe Terms of Use

Version 2026-11 · Published November 4, 2026 · Effective: immediately for new Accounts and from December 4, 2026 for existing Accounts

This is a translation. If there is any conflict, the Portuguese version prevails, unless the law of your country requires otherwise.

Plain-language summary (does not replace the full text). Brawe is a social network for people 18 and older with a feed, stories, lives, messages, virtual Gifts, a creator program, and a Marketplace. The Content you post remains yours. Coins are credits for use inside the app, not money. Creators receive part of the value of Gifts. We prohibit illegal, sexual, and hateful Content, scams, and any exploitation of minors. You can appeal moderation decisions and delete your Account whenever you want. Your consumer rights in your country continue to apply.

1. Who we are and who these Terms apply to

1.2. These Terms of Use (“Terms”) govern the use of the Brawe app for iOS and Android, the brawe.app website, and all services, features, and content we offer (together, the “Services”).

1.3. The following are part of these Terms as if transcribed here:

  • the Privacy Policy;

  • the Child Safety Policy (brawe.app/child-safety);
  • the specific terms you accept when you join a feature: Creator Terms, Marketplace Terms, Advertiser Terms, and Referral Program Rules;
  • the rules of each event or campaign.

1.4. If there is a conflict, the specific document prevails over the general one, and the mandatory public-order rules of the user’s country prevail over all of them.

3. Acceptance

3.1. By creating an Account, checking the acceptance box, or using the Services, you declare that you have read, understood, and accept these Terms and the Privacy Policy. We keep the accepted version, and the date, time, and IP address of acceptance.

3.2. If you do not agree, do not use the Services.

3.3. If you use the Services on behalf of a company or brand, you declare that you have authority to bind it to these Terms.

4. Who can use Brawe

4.1. Minimum age. The Services are intended exclusively for people who are 18 years of age or older, or who have reached the age of majority in their country of residence, if higher (for example, 19 in South Korea and 20 in Thailand). We ask for your date of birth at sign-up and block anyone who does not meet the minimum age.

4.2. We may ask for proof of age at any time, by document or through a specialized verification service. Accounts of minors are closed and the data deleted, except what is necessary to protect the minor or comply with the law.

4.3. Restrictions. You may not use the Services if you:

  • have previously had an Account closed for a serious violation, unless we expressly authorize you;
  • are prohibited by law from receiving the Services;
  • reside or are located in a country or region subject to comprehensive sanctions by the UN, the US (OFAC), the European Union, or the United Kingdom;
  • appear on lists of sanctioned persons.

4.4. The Services are not available in every country. Paid features, Earnings, and the Marketplace may be available only in some countries.

5. Your Account

5.1. Accurate information. You must provide true, complete, and up-to-date information, including name, e-mail, and date of birth. We confirm your e-mail by code before creating the Account.

5.2. One person, one account. Each person may have one personal Account. Brand or business Accounts are permitted when identified as such. The following are prohibited:

  • fake accounts;
  • accounts created to evade a suspension;
  • unauthorized bots;
  • buying, selling, renting, or transferring Accounts.

5.3. Username. The @ handle may not impersonate another person or brand, violate third-party rights, or be offensive. We may reclaim names that are inactive or that violate these Terms.

5.4. Security. You are responsible for keeping your password confidential and for the activities carried out on your Account, except where they result from our failure. Notify us immediately at support@brawe.app if you suspect unauthorized access. We will never ask for your password by message.

5.5. Verified badge. The badge indicates that we have confirmed the identity or authenticity of the Account. It is not an endorsement, does not guarantee the quality of the Content, and may be removed if the conditions are no longer met. The badge may not be sold or transferred.

5.6. Verification for financial features. To receive Earnings, sell on the Marketplace, or advertise, you must go through identity verification (KYC), which may include:

  • an official ID document;
  • CPF or CNPJ (or an equivalent document in your country);
  • bank details;
  • a selfie.

This verification complies with anti-money-laundering, tax, and sanctions laws.

6. The Services

6.1. Brawe offers, among other things:

  • a feed of posts with photos, videos, audio, and custom covers;
  • stories that stay visible for 24 hours;
  • live broadcasts (lives), lives with guests, and battles between creators;
  • direct messages with media, audio, files, location, view-once messages, reactions, editing, forwarding, and translation;
  • virtual Gifts, Coins, and the Rewards Wallet;
  • Gamification: levels, badges, ranks, missions, leaderboards, and events;
  • the Creator Program (Brawe Creator Network);
  • the Marketplace, ads, and the referral program.

6.2. Evolution. We may create, change, or discontinue features to improve the Services, comply with the law, or for security reasons. If a change materially affects a paid feature you have already purchased, we will give reasonable advance notice and offer an alternative or a pro rata refund, where the law requires.

6.3. Availability. The Services depend on the internet, app stores, and suppliers. Interruptions may occur for maintenance, updates, or events beyond our control. We will make reasonable efforts to give notice of scheduled maintenance.

6.4. App license. We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app on devices you control, for lawful personal or professional use. This license is also subject to the Apple terms (Licensed Application EULA) or Google Play terms, as applicable.

6.5. Technical prohibitions. The following are prohibited:

  • copying, modifying, decompiling, or reverse engineering the app, except where the law permits;
  • collecting data from other users through scraping, robots, or automated means without written authorization;
  • circumventing limits, filters, blocks, or security measures;
  • interfering with the operation of the Services or overloading them;
  • manipulating metrics (followers, likes, views, leaderboards, battles) by artificial means;
  • using the Services to train artificial intelligence models without authorization.

7. Your Content

7.1. Ownership. You remain the owner of the Content you post. Nothing in these Terms transfers ownership of your Content to us.

7.2. License you grant us. To operate the Services, you grant us a worldwide, non-exclusive, royalty-free license, sublicensable only to our service providers. With it we may:

  • host, store, copy, and transmit the Content;
  • display and distribute the Content within the Services, according to the visibility settings you choose;
  • technically adapt the Content (compression, transcoding, cover cropping, captions, and automatic translation);
  • display excerpts of public Content on Brawe’s official channels to promote the Services, always crediting the author. You may object to this promotional use at privacy@brawe.app.

7.3. License term. The license ends when you delete the Content or the Account. Technical copies are removed within 90 days. The license continues only:

  • as to Content that other users have already shared or interacted with, such as a message sent to another person;
  • for the retention period required by law or by order of an authority;
  • for defense in legal proceedings.

7.4. Your warranties. You declare that:

  • you have all the necessary rights in the Content, including music, images, trademarks, and the image and voice of people who appear in it;
  • you have obtained the consent of the identifiable people in the Content;
  • the Content does not violate the law or these Terms.

7.5. Visibility. Posts, stories, and lives are visible according to the app’s options. Public Content can be seen by any user, shared within the Services, and found in searches. Think before posting personal data of yourself or others.

7.6. No duty to store. We are not a backup service. Keep a copy of any Content that is important to you.

7.7. Music and audio. Sounds and music made available in the Brawe library may only be used within the Services, within the limits of the licenses we have obtained. Commercial use outside the app is not authorized.

7.8. Reviews and comments. Comments and reviews must reflect real experiences. Fake reviews, reviews paid for without disclosure, or automatically generated reviews are prohibited.

8. Community Guidelines

8.1. It is prohibited to post, broadcast, send by message, or promote:

  1. Exploitation of minors: any sexual, sexualized, or grooming content involving people under 18, real or AI-generated. Zero tolerance (clause 9).
  2. Sexual content: nudity, sexual acts, pornographic content, and sexual services, including through an external link.
  3. Intimate images without consent and sexual or defamatory deepfakes.
  4. Hate and discrimination: attacks based on race, color, ethnicity, origin, religion, disability, sex, sexual orientation, gender identity, age, or illness; glorification of Nazism (in Brazil, a crime under Law 7.716/89).
  5. Violence and threats: threats, incitement to violence, terrorism, criminal organizations, gratuitous graphic violence, cruelty to animals.
  6. Harassment and bullying: stalking, humiliation, exposure of personal data (doxxing), coordinated attacks.
  7. Self-harm: encouragement or instructions for suicide, self-mutilation, or eating disorders. Support and awareness content is permitted.
  8. Scams and fraud: pyramid schemes, promises of easy or guaranteed gains, fake investments, phishing, fake giveaways, sale of followers, accounts, Coins, or Gifts outside the app.
  9. Illegal or regulated goods and activities: illicit drugs, weapons, ammunition and explosives, controlled medications, unauthorized betting and gambling, organs, wild animals, forged documents.
  10. Dangerous misinformation: false content that may cause real harm to public health, electoral processes, or in emergency situations.
  11. False identity: impersonating another person, brand, authority, or Brawe itself. Parodies are permitted when clearly identified.
  12. Rights violations: of copyright, trademarks, image, privacy, and honor.
  13. Spam and manipulation: mass messages, malicious links, artificial engagement, networks of fake accounts.
  14. Unidentified advertising: sponsored or paid-partnership content without a clear notice (clause 15).

8.2. The Community Guidelines detail each item with examples and may be updated to reflect new risks.

8.3. Context. We evaluate context: journalistic, educational, artistic, documentary, or whistleblowing content may be kept with a sensitive-content warning, as long as it does not violate the law.

9. Child safety

9.1. Brawe has zero tolerance for child sexual abuse and exploitation (CSAE/CSAM), grooming, and sextortion.

9.2. When we identify this type of content or conduct, we:

  • remove the content and immediately close the Accounts involved;
  • preserve the evidence for the legal period;
  • report to NCMEC (USA, under 18 U.S.C. 2258A), to the Brazilian Federal Police and SaferNet Brasil, and to the authorities of the country involved;
  • cooperate with investigations.

9.3. Use the Report button and choose “Child safety.” These reports are prioritized and reviewed within 24 hours. In case of immediate danger, also contact your local police (in Brazil, Disque 100 or 190).

10. Reports, moderation, and appeals

10.1. How to report. Anyone, whether a user or not, can report Content or an Account:

  • through the Report button in the app;
  • at legal@brawe.app, stating the link, the reason, and, if possible, the law violated.

We confirm receipt and inform the reporter of the decision.

10.2. How we moderate. We use a combination of:

  • automatic filters (prohibited words and patterns, spam);
  • user reports;
  • review by human moderators.

No decision to permanently suspend an Account is made by an automated system alone.

10.3. Possible measures, proportionate to severity and repeat offenses:

  • warning;
  • sensitive-content label;
  • reduced reach;
  • removal of Content;
  • temporary blocking of features (lives, messages, Gifts, Earnings);
  • temporary suspension;
  • closure of the Account.

10.4. Notice and statement of reasons. When we apply a measure, we will tell you:

  • what was affected;
  • the rule violated;
  • whether the decision was automated or human;
  • how to appeal.

We will refrain from giving notice only when the law prohibits it, when there is an order from an authority, or when the notice could cause harm, such as in child safety cases.

10.5. Appeal. You may appeal through the app or at appeal@brawe.app within 6 months of the decision. The appeal is reviewed by a person different from the one who decided, at no cost. If the appeal is accepted, we restore the Content or the Account without delay.

10.6. Orders from authorities. We comply with valid court orders and legal requests. In Brazil, removal of third-party content follows the Marco Civil da Internet (Law 12.965/2014) and the interpretation of the STF (Brazilian Supreme Federal Court). Non-consensual intimate images are removed upon simple notice from the victim (art. 21).

10.7. Abuse of the reporting system. False or mass reports made in bad faith may lead to the suspension of those who make them.

10.8. Protection tools. You can:

  • block and mute users;
  • limit who can message you (everyone, followers, or no one);
  • remove comments;
  • ban people from your lives.

11. Brawe’s intellectual property

11.1. The Brawe brand, logos, the app, the software, the design, the Gifts, the animations, the badges, the ranks, and other elements of the Services belong to us or our licensors. They are protected by Law 9.279/96 (trademarks), Law 9.610/98 (copyright), Law 9.609/98 (software), and international treaties.

11.2. You may not use our trademarks or visual elements without written authorization, except to mention Brawe in an informational way.

11.3. Suggestions. If you send us ideas or suggestions, we may use them freely, with no obligation to pay, without prejudice to any moral rights the law guarantees you.

12. Copyright and other third-party rights

12.1. Notice. If you are the owner, or the owner’s representative, of a copyright, trademark, or image right infringed on the Services, send to copyright@brawe.app:

  1. your identification and contact details;
  2. the work or right infringed;
  3. the exact link to the Content;
  4. a good-faith statement that the use is not authorized;
  5. a statement, under penalty of law, that the information is true and that you are the owner or are authorized to act on the owner’s behalf;
  6. your physical or electronic signature.

12.2. Counter-notice. Anyone whose Content was removed may submit a reasoned counter-notice. In the US, if the owner does not prove that a lawsuit has been filed within 10 to 14 business days, the Content may be restored (17 U.S.C. 512(g)).

12.3. DMCA Agent (US). BRAWE TECHNOLOGIES LTDA, Attn: Copyright Agent, Av. Cândido de Abreu, 776, sala 803, Curitiba/PR, CEP 80530-000, Brazil · copyright@brawe.app.

12.4. Repeat infringement. In appropriate circumstances, we close the Accounts of repeat infringers.

12.5. European Union. Notices made by EU residents follow the procedure of art. 16 of Regulation (EU) 2022/2065 (DSA), and may also be sent through the app’s reporting form.

12.6. Abusive notices. False notices may give rise to liability for those who make them, including for losses and damages.

13. Coins, Gifts, and purchases

13.1. Nature of Coins. Coins are a limited, personal, revocable, non-transferable license to use a digital resource within the Services. Coins:

  • are not currency, electronic money, securities, crypto-assets, or payment instruments;
  • do not earn interest and have no value outside Brawe;
  • may not be sold, exchanged, transferred between Accounts, or converted into money by those who bought them;
  • may only be used to send Gifts and access paid features indicated in the app.

13.2. Purchase. Coins are purchased through the App Store (Apple) or Google Play, with billing, taxes, and receipts issued by those stores, or by another means we indicate in the app or on the website, where the law and store rules permit. The price is shown in local currency before confirmation.

13.3. Validity. Purchased Coins do not expire while the Account is active. Bonus or promotional Coins may have an expiration date informed at the time they are granted.

13.4. Refunds and right of withdrawal.

  1. Refund requests for purchases made on the App Store or Google Play are handled by the store, under its rules.
  2. Brazil: you may withdraw from the purchase within 7 days (CDC art. 49) as to Coins not yet used. Request it through the store or at support@brawe.app.
  3. European Union and United Kingdom: when you buy Coins, you request immediate supply of the digital content and acknowledge that you lose the 14-day right of withdrawal from the moment the Coins are credited (Directive 2011/83/EU, art. 16(m)). While the Coins have not been used, you may request a refund within 14 days through the store or at support@brawe.app.
  4. Coins purchased through fraud, with a third party’s card, or subject to chargeback may be removed from the Account.

13.5. Gifts. When you send a Gift, the corresponding Coins are consumed immediately. Sending is final, except for a proven technical error. Sending a Gift gives the sender no right over the recipient, the Content, or the Creator’s attention. It is prohibited to use Gifts to buy sexual content or illegal services, or as a form of off-platform payment.

13.6. Gifts with effects. Full-screen animations and effects are displayed according to the device’s capability and may vary between devices.

13.7. Spending and self-control. Prices and balance are always shown before sending. We do not sell paid random reward boxes (loot boxes). If you feel you are spending more than you should, contact support@brawe.app: we can limit purchases on your Account.

14. Creator Program and Earnings

14.1. Enrollment. To receive Earnings you must:

  • apply for and be approved in the Creator Program;
  • accept the Creator Terms;
  • complete identity verification (clause 5.6);
  • reside in a country where payments are available.

14.2. Creator share.

  1. Current percentage. The Creator receives 60% (sixty percent) of the reference value of each Gift received in lives (including battles) and 30% (thirty percent) of Gifts received in stories. For other features, the percentage is 60%. The percentage may differ depending on the feature in which the Gift is sent, such as lives (which have broadcast costs), stories, and others, and the percentage for each feature is set out in the table in the Creator Terms. The reference value in reais of each Gift is shown in the Rewards Wallet.
  2. What Brawe keeps. The remaining 40% covers, among other things:
    • App Store and Google Play fees, which may reach 30% of the price paid;
    • taxes on the sale;
    • payment and platform operating costs.
  3. Changes to the percentage. The percentage may be changed due to changes in:
    • taxes and legal charges;
    • fees of app stores or payment partners;
    • exchange rates;
    • regulatory requirements;
    • market conditions.
  4. Differences by country. The percentage may differ by the Creator’s country of residence, reflecting local taxes and costs.
  5. Programs and campaigns. We may offer higher percentages in programs, events, or campaigns for a fixed period. At the end of the period, the standard percentage applies again.
  6. Advance notice. Any reduction of the standard percentage will be announced in the app and by e-mail at least 30 days in advance. Exception: when the change results from a law or tax with immediate effect, notice will be given as soon as possible.
  7. No retroactive effect. A change never affects Earnings from Gifts received before it takes effect.
  8. Right to leave. If the Creator does not agree, they may leave the Creator Program and withdraw the available Earnings, without penalty.
  9. Transparency. The current percentage for each feature, any differences by country, and the history of changes are shown to the Creator in the app, in the Creator Program area.

14.3. High-value Gifts received in stories and messages also generate Earnings and appear in the Creator’s Rewards Wallet.

14.4. Payment. Earnings are paid in legal currency, to an account held in the Creator’s own name, by regulated payment partners. In Brazil, by a payment institution authorized by the Central Bank. In other countries, by an international creator payments provider. These partners perform identity verification (KYC), sanctions screening, and collection of tax forms of the Creator’s country (for example, W-8BEN or W-9 in the US). To receive payment, the Creator also accepts the partner’s terms. Minimum withdrawal amount, deadlines, and fees are in the Creator Terms.

14.5. Withholding and reversal. We may withhold or reverse Earnings related to:

  • fraud, purchase chargebacks, or use of Coins of illicit origin;
  • Gifts exchanged between accounts of the same group to generate artificial Earnings;
  • violation of these Terms or the Community Guidelines;
  • a court order or requirement of an authority.

The withholding will be communicated with the reason and may be contested through the procedure in clause 10.5.

14.6. Taxes. The Creator is solely responsible for declaring and paying taxes on their Earnings in the country where they reside. We will make the withholdings and filings required by law and may ask for tax information for that purpose.

14.7. Independence. The Creator acts independently. Joining the program does not create an employment, partnership, representation, or agency relationship with Brawe.

14.8. Earnings not guaranteed. We do not promise minimum income, reach, followers, or Gifts.

15. Gamification, events, and prizes

15.1. Levels, badges, ranks, and missions are recognition and engagement features. They have no monetary value, are not the user’s property, and may not be sold or transferred. We may adjust criteria, goals, and rewards to maintain balance, without retroactive effect on what has already been earned.

15.2. Leaderboards and battles reflect the scoring rules shown in the app. Manipulation (fake accounts, Gifts between linked accounts, automation) leads to annulment of results and other measures.

15.3. Events, contests, and prizes. Each event with prizes will have its own rules, with criteria, period, prizes, and method of delivery.

  • Performance-based contests, such as creativity or content goals, do not depend on luck.
  • In Brazil, promotions involving a draw, prize voucher, or contest that depends on luck will only be held with prior authorization from the Ministry of Finance (Law 5.768/71).
  • In other countries, we will apply local rules or restrict participation.
  • Prizes may be subject to taxes, as stated in the rules.
  • Participation never requires a purchase, except where the authorized rules so provide.

16. Marketplace

16.1. Brawe’s role. In the Marketplace, Brawe provides the space and tools for sellers (stores or individuals) to offer products to buyers. Unless it is stated that the seller is Brawe itself, the sales contract is entered into between buyer and seller.

16.2. Seller duties. The seller must:

  • be identified with a CPF or CNPJ;
  • describe the product clearly and truthfully, with total price, shipping, deadline, and conditions;
  • issue an invoice when required;
  • comply with the CDC, including the statutory warranty and the 7-day right of withdrawal for online purchases;
  • not sell prohibited (clause 8.1, item 9) or counterfeit products.

16.3. Buyer. The buyer has the rights provided by the consumer law of their country. Problems should first be handled with the seller through the app. If there is no resolution, Brawe mediates the dispute under the Marketplace Terms.

16.4. Liability. We are liable for the services we provide (platform, intermediated payment, and mediation), under the law. Commissions, payout deadlines, and dispute rules are in the Marketplace Terms.

17. Advertisers, advertising, and sponsored content

17.1. Ads on Brawe. We may display ads and sponsored content, always identified as such. We do not use your data for behavioral advertising based on tracking outside Brawe. Current targeting is geographic (country, state, city). We never target ads based on sensitive data.

17.2. Advertisers. Advertisers accept the Advertiser Terms and are responsible for the content of the ad. The ad must comply with:

  • local law;
  • the Consumer Defense Code (CDC);
  • the Brazilian Advertising Self-Regulation Code (CONAR);
  • our Community Guidelines.

Ads for illegal products and services, unauthorized betting, financial schemes, and deceptive content are prohibited.

17.3. Creator paid partnerships. Creators who receive payment, products, or any benefit to promote a brand must identify the content clearly and visibly, for example with “#ad,” “paid partnership,” or the app’s label. This follows CONAR’s Influencer Advertising Guide, FTC rules (US), and Directive 2005/29/EC (EU).

18. Referral Program

18.1. Users may invite people with a personal code or link and receive bonuses for valid referrals, under the Referral Program Rules.

18.2. The program:

  • does not require payment, purchase of a kit, or a membership fee to participate;
  • rewards only direct referrals, with no commissions on referrals made by the people you refer;
  • is not an investment or a guaranteed income opportunity.

18.3. The following are prohibited:

  • promoting the program with promises of profit or passive income;
  • spamming;
  • creating fake accounts to generate referrals;
  • buying referrals.

Fraudulent referrals are annulled, and the corresponding bonuses are reversed.

19. Direct messages

19.1. Messages are private between the participants in the conversation. They are protected in transit (TLS), but are not end-to-end encrypted. We access them only when necessary to:

  • operate the Services (delivery, translation requested by you, link previews);
  • apply automatic filters against spam and scams;
  • review a report, which includes the reported messages;
  • comply with a legal order or protect someone from serious risk.

19.2. View once. View-once photos and videos are deleted from our servers after being opened by the recipient. We cannot prevent someone from photographing the screen with another device. Send only what you would accept being kept.

19.3. Delete and edit. “Delete for me” removes the message only from your screen. “Delete for everyone” removes it for the participants, but may not reach copies already made. Edited messages show an “edited” notice.

19.4. Location and files. Sharing location is always your own one-time action; we do not track your location in the background. Files sent may be scanned for malware.

19.5. Mass commercial messages, chain messages, and persistent contact after being blocked are prohibited.

20. Lives and battles

20.1. When you broadcast, you are responsible for what appears and is heard in the broadcast, including guests and comments you pin.

20.2. Do not broadcast:

  • people without their consent;
  • minors;
  • places where filming is prohibited;
  • events protected by broadcast rights, such as games, concerts, and movies;
  • situations that put you or others at risk.

20.3. Lives may be recorded and kept for up to 30 days for security, moderation, and review of reports. The Creator may have access to the recording, depending on the app’s features.

20.4. We may interrupt a live in progress that violates these Terms.

21. Third-party features, translation, and artificial intelligence

21.1. Third-party services. Sign in with Apple or Google, app stores, maps, and external links are provided by third parties, with their own terms and policies. We do not control external sites accessed through links posted by users.

21.2. Automatic translation. Translations of messages and posts are generated automatically and may contain errors. Do not use them as an official translation.

21.3. AI-generated or altered content. Realistic content created or materially altered by AI must be identified by the person who posts it. It is prohibited to use AI to:

  • create sexual content of real people;
  • imitate someone’s voice or image without consent;
  • deceive about facts.

21.4. If we begin to use generative AI in Brawe features, we will inform you in the app and in the Privacy Policy, with the applicable control options.

22. Suspension and termination

22.1. By you. You may delete your Account at any time at Settings → Account → Delete account, or on the page brawe.app/account-deletion. Deletion:

  • removes your profile, Content, and personal data within the periods in the Privacy Policy, except what the law requires us to keep;
  • does not refund Coins already used. Unused Coins follow clause 13.4;
  • requires Creators to withdraw available Earnings beforehand. Earnings not withdrawn remain available for 180 days upon request to support@brawe.app.

22.2. By us. We may suspend or close your Account, or restrict features, when:

  • there is a serious or repeated violation of these Terms;
  • there is a risk to other users, third parties, or the Services;
  • there is fraud or well-founded suspicion of fraud;
